Terms of Service

These Terms of Service govern your use of DITO. The service is currently in beta and these terms are drafted to global standards so that no single jurisdiction’s law unduly restricts you.

1. The service

DITO (the "service") is a beta service operated by DIGI PLANET. Through daily conversations with an AI coach (Ember), you explore your talents, keep a record of your progress, and—when you are ready—seal that record permanently on Solana by minting an Ember. We provide the application, the storage, and Ember itself.

The service is provided in beta for demonstration and validation, and is not operated on a commercial basis at this time. Amounts such as the $1 USDC used at Ember minting are intended to cover on-chain network fees and infrastructure costs; they are not revenue. If paid features are introduced in the future, they will be governed by separate terms that we will communicate clearly in advance.

2. Eligibility

  • You must be at least 16 years old to use DITO (consistent with the GDPR and other global safety standards).
  • You must comply with the laws of your country of residence, including any laws that restrict your use of the service or your ability to hold digital assets.

3. Your account

  • You are responsible for keeping your password and your wallet’s private key and seed phrase secure. We do not store your private key.
  • Each person may hold only one account, and you may not impersonate any other person.
  • You may close your account at any time. We may suspend accounts that abuse the service or other users.

4. Your content

Everything you create—entries, reflections, and ember names—remains yours. We do not claim ownership of your content. External LLM providers do not train their own models on your content (see Privacy §4), and we do not sell raw content. Any internal training of DITO’s own talent-discovery algorithms takes place only with your separate opt-in consent (see Privacy §3, "Consent").

You grant us a limited, technical license to store and display your content back to you (for example, to encrypt it, sync it across your devices, and render it in the app). This license terminates when you delete the content or close your account.

5. About Ember (the AI coach)

Ember is an assistant powered by large language models, designed to respond in a calm, coach-like tone. Ember is not a therapist, physician, lawyer, or financial or tax advisor. If you are in crisis, please contact a qualified human professional or your local emergency services.

Ember can be wrong. Treat its responses as material for reflection, not as facts to be acted on without review. To generate a response, your messages are transmitted to external LLM providers, as described in Privacy §4.

You may not use Ember to facilitate harm to yourself or others, including self-harm, suicide, homicide, assault, terrorism, or any similar act. Ember will not respond to such requests, and we may suspend the account and, where appropriate, report the matter to the relevant authorities.

6. Solana wallet and Ember minting

Embers are non-transferable (Soulbound) tokens issued on the Solana public blockchain. DITO currently operates on Solana Devnet while in demo; we will provide separate notice before any mainnet migration. Please review the following carefully:

  • Irreversible — Once minted, an Ember cannot be reversed, modified, or transferred by anyone, including us. Please review the details carefully before minting.
  • No refunds and no changes — On-chain transactions (such as the $1 USDC and applicable network fees) are inherently non-refundable, and the contents of a minted Ember cannot be changed afterwards. Any amount received by the operator is used to cover infrastructure and operating costs on a non-commercial basis.
  • Network fees — Solana network gas and fees are outside our control. They vary with network conditions and are deducted directly from your wallet.
  • Public and permanent — Transaction hashes, your public wallet address, and Ember metadata are globally readable and permanent. You must accept this before you mint.
  • Activity outside DITO — Any loss arising from Solana activity outside the contracts and operations designated by DITO (including third-party dApps, tokens, smart contracts, or phishing schemes) is your sole responsibility, and the operator bears no liability for it.

7. Wallet loss and recovery limits

Your wallet—including its private key and seed phrase—is under your sole control. Because we never hold your private key, we cannot directly restore a lost wallet.

Each Ember is permanently bound to the wallet to which it was minted. If you lose access to that wallet, we can verify your identity using your registered email and re-bind the Ember to a new wallet. Any costs of re-issuance (such as Solana network fees and re-mint costs) are your responsibility. The contents of a minted Ember cannot be modified, and minting fees are never refundable. We cannot guarantee re-binding in cases where your identity cannot be verified (for example, if you have also lost access to your registered email).

You are responsible for keeping your wallet, seed phrase, and registered email secure.

Important: We will never ask you for your private key, seed phrase, password, one-time password, or any additional payment (extra fees, transfers, or similar). Any such request is an impersonation attempt; do not respond, and please report it to us immediately.

8. Acceptable use

  • Do not use the service to harm yourself or others, or to threaten any person.
  • Do not attempt to compromise the service, including by reverse-engineering, scraping, abusing APIs, or evading rate limits.
  • Do not upload unlawful content, content that infringes another person’s rights, or hateful, violent, or child sexual abuse material.
  • Do not provide Ember with sensitive information (such as government identification numbers, payment cards, or medical records) or third-party identifying information.
  • Do not resell, white-label, or wrap the service without our prior written permission.
  • Do not violate any sanctions or digital-asset or blockchain regulations applicable in your jurisdiction.

9. Beta availability

The service is offered in beta. We make no commitment regarding uptime or data preservation under a service-level agreement. We may change, pause, or discontinue parts of the service; if we remove a material feature, we will provide at least 30 days’ prior notice.

10. Disclaimers and limitation of liability

The service is provided on an as-is and as-available basis. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and data integrity. Your use of DITO and Ember, and any wallet or on-chain activity, is at your own risk.

To the maximum extent permitted by applicable law, the operator’s total liability for any claim arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months preceding the claim or USD $50. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability; in those jurisdictions, the limits above may not apply to you.

11. Termination

You may stop using DITO at any time. We may suspend or terminate your account if you breach these terms or if we are required to do so by law. Upon termination, you may export your data for 30 days, after which it will be permanently deleted (except on-chain data, which remains permanent in accordance with Privacy §5).

12. Governing law and disputes

These terms are governed by the laws of the Republic of Korea. However, mandatory consumer protection laws in your country of residence prevail over these terms, and nothing in these terms limits any such rights you may have.

We will seek to resolve disputes amicably in the first instance. Failing resolution, the Seoul Central District Court will be the agreed venue, except where mandatory law in your country of residence requires a different forum.

Users in Korea may apply for mediation through the Korea Consumer Dispute Conciliation Commission (ccn.go.kr). Users in the EU or EEA may use the European Commission’s Online Dispute Resolution platform (ec.europa.eu/consumers/odr/).

13. Changes to these terms

If we change these terms, we will notify you in the app and update the date at the top of this page. Material changes will take effect no earlier than 30 days after notice so that you have time to review them.
